In accordance with § 13(1) of the AGG, 

  • employees
  • civil servants
  • trainees
  • interns
  • job applicants
  • persons whose employment at Ulm University has ended

may lodge a complaint with the complaints office regarding discrimination they have personally experienced in the areas listed below, which are materially related to their employment relationship. 

The complainant and any supporting persons shall not suffer any detriment as a result of exercising their right to complain. 

The complaint will be investigated by the complaints office, and the facts of the case will be established using all means available to the employer. To this end, the parties concerned are regularly heard. 


It is possible to lodge an anonymous complaint; in such cases, the complainant waives the right to be informed of the outcome of the complaint. However, this may mean that the facts of the case can only be clarified to a limited extent, as the complainant cannot be heard as a witness. In this case, the complainant has no right to have the facts of the case and the complaint kept confidential. 

The outcome of the investigation will be communicated to the complainant within two weeks.

  • Race or ethnic origin
    It is prohibited to discriminate against employees on the grounds of their origin, ancestry, skin colour, language or national origin.
  • Gender
    Anyone who treats employees less favourably solely on the grounds of their gender is discriminating on the grounds of gender. Less favourable treatment of a woman on the grounds of pregnancy or maternity also constitutes discrimination.
  • Religion or worldview
    The term ‘religion’ refers to all recognised religious communities, such as Christianity, Judaism, Islam or Buddhism. A worldview is each person’s individual view and conception of the world and the role of the individual and society, such as pacifism or atheism. Purely political opinions, however, do not fall under either of these two categories.
  • Disability
    Protection against discrimination applies not only to people with severe disabilities, but to all people who have a disability within the meaning of the AGG.
  • Age
    No employee may be disadvantaged on the grounds of a particular age. The specific age group is irrelevant in this context.
  • Sexual identity
    Sexual identity or orientation refers to the primary focus of a person’s sexual interests with regard to their preferred partners. Sexual identity encompasses both a person’s fundamental orientation and the individual way in which they live out their sex life, as well as their understanding of their own gender role (e.g. living in a marriage or celibacy). Discrimination is also prohibited if it is based solely on assumptions regarding a particular sexual orientation.

  1. The complaint is submitted to the complaints office.
  2. The facts of the case are investigated. The parties involved are regularly consulted and any further evidence is examined where necessary.
  3. An assessment is made as to whether a breach of the General Equal Treatment Act (AGG) has occurred or could have occurred.
  4. The outcome of the investigation is communicated to the complainant and, depending on the outcome, forwarded to the relevant department within the University responsible for employment law, disciplinary matters or other measures (e.g. in cases of discrimination by other members or affiliates of the University).
  5. The employer will take appropriate measures under employment law, initiate disciplinary proceedings or arrange other safeguards to prevent further discrimination.
